Acceptable Use Policy

1. Introduction

This Acceptable Use Policy (this “Policy”) supplements the Vivix Terms of Service (the “Terms”) and governs your access to and use of the application programming interfaces, software, tools, data, documentation, and related services (collectively, the “Services”) provided by VIVIXSG PTE. LTD. (“Vivix”, “we”, “us”, or “our”). This Policy applies to any of Your Content you submit, any Output you generate, and your use of such content within and outside the Services. Capitalized terms not defined in this Policy have the meanings set forth in the Terms.

This Policy is designed to promote the safe, lawful, and respectful use of our Services and to protect the rights of individuals depicted in or affected by content created on our platform. By using the Services, you agree to comply with this Policy. Attempts to circumvent or violate this Policy will not be tolerated. Violations of this Policy constitute a material breach of the Terms and may result in the removal of content, suspension or termination of your access to the Services, reporting to law enforcement authorities, or other actions described in Section 7 below.

2. General Requirements

You agree to:

  • Comply with all applicable laws, regulations, and third-party rights, including intellectual property, data protection, privacy, biometrics, artificial intelligence, export control, and sanctions laws;
  • Use the Services in accordance with the Terms, any applicable Documentation, and this Policy;
  • Obtain all necessary rights, licenses, consents, and permissions required for any of Your Content you submit, including explicit, informed consent from individuals whose likeness, voice, or biometric identifiers are included in any source materials;
  • Monitor and control all activity conducted through your account, including activity by your Authorized Users and end-users; and
  • Use commercially reasonable efforts to prevent unauthorized access to and use of the Services.

3. Prohibited Uses

You may not use the Services, or create, upload, or distribute any of Your Content or Output for any of the following purposes. This applies to content created through any feature of the Services, including via our APIs. The following list of prohibited uses is not exhaustive, and Vivix reserves the right to determine, in its sole discretion, whether any conduct violates this Policy.

3.1 Child Safety & CSAM

Any content that exploits, harms, or endangers minors is strictly prohibited. This includes:

  • Content that depicts or facilitates child sexual abuse material (“CSAM”), sexual exploitation, grooming, or trafficking of minors;
  • Exposing minors to sexually explicit, violent, or otherwise inappropriate material; and
  • Sexualized, exploitative, abusive, or otherwise harmful depictions of minors, including content that facilitates underage impersonation for abusive or deceptive purposes.

Vivix has a zero-tolerance policy for child exploitation. We will report any apparent CSAM to the National Center for Missing and Exploited Children (NCMEC) and/or other relevant law enforcement authorities, and will immediately terminate all associated accounts.

3.2 Violence, Terrorism, and Dangerous Activity

Content that promotes, incites, glorifies, or facilitates violence, terrorism, or criminal behavior is prohibited, including:

  • Threats of violence against individuals or groups;
  • Coordination of violent acts or warfare;
  • Content supporting designated terrorist organizations or entities engaged in malicious offline or online harm;
  • Promotion of weapons, ammunition, or explosives; and
  • Content depicting gore, dismemberment, beheadings, mutilations, or other graphic violence.

3.3 Fraud, Scams, and Deceptive Practices

Content that facilitates fraud, scams, phishing, identity theft, or other deceptive practices is prohibited, including:

  • Impersonation of individuals or entities without appropriate disclosure;
  • Promotion of fraudulent financial schemes (including cryptocurrency scams, Ponzi schemes, and pyramid schemes);
  • Social engineering attacks; and
  • Use of the Services to obtain unauthorized access to non-public information.

This includes using the Services to develop, operate, or facilitate any product or service that violates applicable laws in the jurisdiction where you are located or where Vivix’s headquarters are located.

3.4 Impersonation, Unauthorized Likeness Use & Deepfakes

Creating content that replicates the voice, likeness, or identity of another individual without their explicit consent or legal right, or in a manner intended to deceive, harass, or cause harm, is strictly prohibited. This includes impersonation of public figures, government officials, or private individuals, whether for financial gain, reputational harm, or any other purpose.

Generating “deepfakes” (realistic AI-generated or manipulated content depicting a real person) without clear and conspicuous disclosure that the content has been artificially generated or manipulated is prohibited to the extent required under applicable law. You are solely responsible for complying with all deepfake disclosure laws (including EU AI Act and other applicable U.S. state, federal, or international requirements). You must not remove, obscure, or alter any provenance data, watermarks, or AI-generation indicators embedded by us or our subprocessors.

3.5 Hate Speech and Discrimination

Content that promotes hatred, discrimination, or violence based on protected characteristics is prohibited, including:

  • Race, ethnicity, national origin, religion, caste, gender, gender identity, sexual orientation, age, disability, veteran status, or any other protected classification;
  • Slurs, dehumanizing language, harmful stereotypes, and expressions of contempt or disgust toward individuals or groups;
  • Content that promotes or incites violence against individuals based on any of the foregoing characteristics.

3.6 Harassment and Bullying

Content that threatens, intimidates, shames, humiliates, bullies, stalks, or harasses any individual, or that promotes or celebrates the suffering of others, is prohibited.

3.7 Sexual and Explicit Content

Content that is sexually explicit, pornographic, or depicts sexual acts, nudity, or other adult material is prohibited, regardless of whether the content depicts real or AI-generated individuals. This includes non‑consensual intimate imagery (NCII).

3.8 Misinformation and Disinformation

Content that is intended to deceive the public or foreseeably cause harm through false representations of fact on topics including elections, public health, civic processes, or current events is prohibited. This includes participation in coordinated disinformation campaigns or inauthentic behavior intended to manipulate public opinion.

3.9 Political Content

Content that is used for partisan political campaigning, candidate promotion, voter suppression, or election interference is prohibited. This includes:

  • Voter suppression or voter misinformation;
  • Impersonation of political candidates or government officials;
  • Any use that is deceptive, harmful, or intended to manipulate civic processes; and
  • Election-related disinformation or interference.

Use of the Services for legitimate non-partisan civic education purposes requires prior written approval from Vivix.

3.10 Self-Harm and Suicide

Content that promotes, encourages, or provides instructions for suicide, self-harm, or eating disorders is prohibited.

3.11 Regulated Goods and Services

Content that promotes or facilitates the sale or exchange of illegal or restricted goods and services is prohibited, including:

  • Illegal drugs and controlled substances;
  • Weapons, ammunition, or explosives;
  • Counterfeit goods or stolen property;
  • Human trafficking or commercial sexual services; and
  • Alcohol, online gambling, or other age-restricted goods where promotion would violate applicable law.

3.12 Intellectual Property Infringement

Content that infringes, misappropriates, or violates the intellectual property rights of any third party is prohibited, including:

  • Copyrighted images, videos, audio, or text used without authorization from the rights holder;
  • Trademark infringement or dilution;
  • Unauthorized use of a person’s name, likeness, or voice in violation of their right of publicity or personality rights; and
  • Use of the Services to create content that replicates the distinctive artistic style of a known living artist where such use (i) is intended to deceive others into believing the content was created by that artist, or (ii) otherwise infringes the artist’s enforceable legal rights.

3.13 Professional Advice Without Qualification

Using the Services to provide tailored legal, medical, financial, or other professional advice without both the involvement of a qualified professional and clear disclosure that the content is AI-generated is prohibited. General informational or educational content is permitted, but content that is individualized or could be reasonably relied upon as professional guidance requires appropriate human oversight.

3.14 Platform Integrity and Security

Any activity that threatens the integrity, security, or availability of the Services is prohibited, including:

  • Attempts to reverse engineer, decompile, disassemble, or otherwise derive source code from the Services, except to the extent expressly permitted by applicable law;
  • Attempts to extract, reconstruct, or replicate the underlying models, weights, parameters, or algorithms of the Services through any means, including repeated API queries or analysis of Outputs;
  • Bypassing, circumventing, or attempting to bypass or circumvent any usage limits, rate limits, quota restrictions, or other access controls imposed by Vivix, including through the use of multiple accounts, API keys, or other means;
  • Using any non-public information obtained from the Services to build, develop, or improve a substitute or competitive product or service;
  • Submitting, uploading, or otherwise providing any data or content to the Services that is intended to degrade, corrupt, manipulate, or adversely affect the performance, output, security, or training of the Services or any underlying AI models;
  • Unauthorized access to accounts, systems, or networks (e.g., credential stuffing, password spraying, or other brute-force attacks);
  • Uploading malicious code, viruses, trojan horses, worms, logic bombs, or other harmful software;
  • Circumventing, removing, deactivating, degrading, or thwarting any content filters, rate limits, access controls, safety measures, or technological protection measures of the Services;
  • Scraping, crawling, extracting, or otherwise collecting any content or data from the Services using any automated system or software (including “bots” or “spiders”) for any purpose, including for training AI models, without Vivix’s prior written approval;
  • Creating multiple accounts to exploit free usage quotas or credits, or to evade enforcement actions;
  • Using the Services to build a competing product or service;
  • Reselling, sublicensing, or otherwise making the API available to third parties for commercial purposes without Vivix’s prior written authorization; and
  • Accessing the Services for benchmarking, comparative, or competitive purposes without Vivix’s prior written consent.

3.15 U.S. Laws Compliance

You may not use the Services in any manner that would violate any applicable U.S. laws or regulations, including Executive Order 14117 or its implementing regulations (28 CFR Part 202). This includes, without limitation:

  • Engaging in any covered data transaction that is prohibited or restricted under 28 C.F.R. Part 202, except in compliance with all applicable legal and security requirements;
  • Using the Services in any manner that would constitute a prohibited data brokerage transaction or restricted transaction under 28 CFR Part 202 without implementing the required Cybersecurity and Infrastructure Security Agency (CISA) security requirements; and
  • Engaging in any transaction designed for the purpose of avoiding the application of Executive Order 14117 or 28 CFR Part 202.

You represent and warrant that you will not cause Vivix to violate any applicable U.S. export control or sanctions laws.

3.16 Compliance with Applicable AI Laws

You may not use the Services in any manner classified as “prohibited” under applicable artificial intelligence laws and regulations, including but not limited to:

  • The EU Artificial Intelligence Act, which prohibits certain AI practices (e.g., social scoring, real-time remote biometric identification in publicly accessible spaces for law enforcement purposes subject to limited exceptions, and certain manipulative or exploitative practices);
  • Any applicable U.S. state laws governing artificial intelligence that impose restrictions on high-risk AI systems or prohibited AI practices; and
  • Any other applicable international AI regulations.

You are responsible for independently assessing your obligations under applicable AI laws based on your specific use case and jurisdiction. Uses classified as high-risk or otherwise regulated require Vivix’s prior written approval and must comply with all applicable legal requirements. Vivix reserves the right to determine, in its sole discretion, whether a proposed use constitutes a high-risk or otherwise restricted use, and to suspend or terminate access accordingly.

4. Your Obligations as a Customer

4.1 Flow-Down to End-Users

You must implement and maintain an acceptable use policy for your end-users that is at least as restrictive as this Policy. You must ensure that your end-users do not use your application or service in any manner that would violate this Policy if done directly, including by implementing age verification (where required) and content moderation systems. You agree to be fully liable to Vivix for any violation of this Policy by your end-users.

4.2 AI-Generated Content Labeling

You must incorporate in your applications clear and conspicuous disclosures that content generated by the Services is AI-generated or AI-assisted, to the extent required by applicable law. These disclosures must be visible to your end-users and not easily removed or obscured. You shall not remove, alter, or obscure any provenance data, watermarks, content-authenticating metadata, or AI-generation indicators that Vivix embeds in API responses or Output.

4.3 Reporting Violations

You must promptly report any known or suspected violations of this Policy to Vivix at customerservice@vivix.ai, including providing a description of the suspected violation, the content in question, and any supporting information. You must also cooperate with us in any investigation of suspected violations.

5. Conditional Content

Certain types of content are generally permitted but subject to additional restrictions due to their sensitive nature. Vivix may, in its sole discretion, determine whether content falls under this section or is prohibited under Section 3. Conditional content includes:

  • Educational and Informational Content: Content addressing sensitive topics (such as health, human biology, or violence) that is purely educational or informational in nature may be conditionally permitted, provided it is clearly labeled as mature content where appropriate, is not targeted at minors, is developed in a respectful and non-exploitative manner, and complies with all applicable laws.
  • Religious Content: Content discussing religion or belief systems is permitted when presented respectfully and does not promote division, discrimination, or hatred.

6. Content Moderation

6.1 Automated Review

Vivix uses automated moderation tools, powered by machine learning algorithms and other technologies, to scan and flag Your Content and Output that may violate this Policy.

6.2 Human Review

Content flagged through automated systems, user reports, or other means may also be reviewed by human moderators. Vivix reserves the right to review any of Your Content or Output for compliance with this Policy, but is not obligated to do so.

6.3 Reporting Violations

If you believe that content created through the Services violates this Policy, please report it to customerservice@vivix.ai with: (a) a description of the content and its location (if accessible); (b) a description of the reason you believe it violates this Policy; and (c) your contact information. We will review the report and take appropriate action in our sole discretion.

7. Enforcement

If Vivix determines, in its sole discretion, that you or any of your end-users have violated this Policy, Vivix may take one or more of the following actions, taking into account the severity of the violation:

  • Issue a warning to you;
  • Remove or disable access to Your Content or Output that violates this Policy;
  • Prevent the generation of further Output;
  • Temporarily suspend your access to the Services;
  • Permanently terminate your account and your access to the Services;
  • Report the violation to law enforcement or other relevant authorities (including, in the case of CSAM, reporting to NCMEC); and/or
  • Take any other action Vivix determines is appropriate under the circumstances.

If Vivix terminates your access to the Services due to a violation of this Policy, you are not entitled to any refund of pre-paid fees (if any). Enforcement of this Policy is at Vivix’s sole discretion. Vivix’s failure to enforce this Policy in any instance does not constitute a waiver of its right to enforce it in other instances.

8. Appeals

If you believe that a moderation decision under this Policy was made in error, you may submit an appeal by emailing customerservice@vivix.ai within thirty (30) days of the decision, providing: (a) a description of the content that was deemed to violate this Policy; (b) a description of the reason you believe the decision was incorrect; and (c) your contact information. Vivix will review appeals in its sole discretion. Where possible, appeals will be reviewed by a person not involved in the original decision. Submission of an appeal does not guarantee a response or reversal of the original decision.

9. Updates to This Policy

Vivix may revise this Policy from time to time in response to technical advancements, legal requirements, societal changes, or user feedback. Changes take effect immediately upon posting on this page. Your continued use of the Services after the modifications become effective constitutes your acceptance of the revised Policy. If we make material changes to this Policy, we will make reasonable efforts to notify you, such as via email or through the Services.
